Christopher Kenny, a 23-year-old man stripped the unconscious woman n*ked and then took photos of her genitals. He pretended he had deleted them, then later called her a ‘b****’ on social media.
Daily Mail reports that Kenny from Marleston, South Australia, has pleaded guilty to one count of indecent filming and has been labelled a ‘deviant’ by a prosecutor for his actions.
Kenny had taken six photographs of a young woman’s genitals using a mobile phone after she’d passed out at a New Year’s Eve party in January 2013.
His friends had drawn mustaches on her face before he took the images.
But she was awoken by the sound of the camera on his phone and demanded he deleted the pictures.
He said he had, but actually hid them using an app on his phone which made it appear as if they’d been removed.
Kenny was initially charged with rape, but when the charge was withdrawn, he posted on Facebook, calling the woman a ‘b****’ and that she would ‘get what was coming to her’, it was reported.
In an SA district court, the woman’s mother read out a victim impact statement and said her daughter was still traumatised by what had happened, calling Kenny a ‘predatory coward’.
During sentencing submissions before Chief Judge Geoffrey Mueck, it was heard that Kenny could face a maximum of two years’ imprisonment or a fine of up to $10,000.
Prosecutor Peter Longson called for him to be jailed.
‘I’ve no doubt he’s remorseful — but that’s because he’s in the dock — his ‘remorse’ is best exemplified by what he said on Facebook,’ he said.
‘Whether or not he would have said it to her face is irrelevant … Facebook tells you what you need to know about Christopher Kenny.’
He said Kenny’s behaviour was ‘deviant’.
Kenny’s lawyer, Jane Abbey, said jailing him would not benefit him or the community and that he was had‘overwhelming remorse and embarrassment’.
